Florida's 21+ Rules: What ID You Need to Buy Vapes and Hemp

Two questions come up again and again with visitors: 'will you take my passport?' (yes) and 'why did you card me?' (because we card everyone — it's simpler and safer than guessing).

Since the rules changed twice in recent years — federally in 2019 and in Florida's own statutes in 2021 — here's the current state of play, with the actual laws cited below.

The age is 21, at two levels of law

Federal law moved first: in December 2019, the minimum age to buy any tobacco product in the United States — cigarettes, cigars, smokeless, hookah tobacco, e-cigarettes and vaping products included — rose from 18 to 21. That's the FDA's 'Tobacco 21' law, and it applies in every state with no exceptions for military service or anything else.

Florida then aligned its own statutes: since October 2021, Chapter 569 sets 21 as the minimum age for tobacco and nicotine products in Florida, and it reaches sales, possession and misrepresenting your age to buy. Retailers face real penalties for getting it wrong, which is the honest reason the carding is so consistent here.

Hemp has its own Florida wrinkle: the state hemp statute restricts inhalable hemp products to 21 and up, and as a practical matter Florida retailers apply 21+ across hemp products generally. However you slice the statutes, the answer at the register is the same: 21, with ID.

Which IDs actually work

What a retailer needs is a government-issued photo ID showing date of birth. In practice, at our counter and most others in Florida, that means:

• Any U.S. state driver's license or state ID card (it does NOT need to be a Florida license)
• A passport from any country — the standard answer for international visitors
• A U.S. military ID
• U.S. permanent resident card

Good to know: a photo of your ID on your phone doesn't work — Florida retail practice requires the physical document. And an expired ID is a judgment call that usually goes against you; carry the real, current thing.

How it works for visitors and deliveries

There's no tourist exception to the age, but there's also no residency requirement — a 21-year-old visitor with a valid foreign passport buys exactly like a local. If you're used to 18 as the age at home, the American rule catching a 19- or 20-year-old traveler by surprise is common enough that it's worth saying plainly: 21 is the line, and it can't be waived.

The rule follows the product wherever it's sold, including delivery: our drivers check ID at handoff, so have the same document ready at the hotel entrance that you'd show at the counter. An order that can't be age-verified at the door doesn't get handed over — that's the law working as designed, not driver stubbornness.
