It's a question visitors run into fast, often right after a stern look in a hotel lobby: where, exactly, are you allowed to smoke around here?
The short answer is outdoors, in designated spots — but the reason is worth two minutes, because Florida's rules are stricter than many visitors expect, they apply to vaping as well as smoking, and the fines for lighting up in a nonsmoking hotel room are real money.
The law behind the stern looks
Florida's Clean Indoor Air Act prohibits smoking in enclosed indoor workplaces — which in practice means restaurants, shops, lobbies, theaters, and nearly every indoor space a visitor walks through. Since 2019 the same law covers vaping, so an e-cigarette in a restaurant is treated the same as a cigarette. There are only a handful of exceptions, the main one being stand-alone bars — defined in the statute as bars deriving no more than 10% of gross revenue from food sales.
Hotels sit in a specific carve-out: they may designate a portion of guest rooms as smoking rooms. Many Orlando hotels choose not to — a lot of I-Drive properties are entirely smoke-free — and the cleaning fee for smoking or vaping in a nonsmoking room commonly runs into the hundreds of dollars — the exact amount is set by each property. If a smoking room matters to you, confirm it when booking, not at check-in.
Good to know: since a 2022 change to state law, Florida cities and counties can also ban smoking in their public parks and beaches. Rules vary block to block, so posted signs are the authority in any park.
What this looks like on I-Drive
Practically, the corridor works like this: most hotels maintain an outdoor designated smoking area — often a side patio or a spot near a secondary entrance with an ashtray receptacle — and where exactly it sits is the property's call, so the front desk is the fastest answer. It's one of the most routine questions they get.
The big attractions handle it the same way. ICON Park, the convention center, and the outlet malls are nonsmoking except in marked outdoor areas, and each theme park sets its own designated-location policy — check the park's official site or ask at guest services. Restaurants are indoor-nonsmoking by law; some patios allow it, some don't — that's the owner's call, so ask before lighting up.
One habit that saves tourists grief: don't assume an open-air space is fair game. Pool decks, balconies and patios are usually covered by the property's own policy even where the state law doesn't reach, and balconies are the single most common way visitors end up with a room fee.

Frequently Asked Questions
Is vaping treated the same as smoking in Florida?
